SUMMIT GUIDES BOOKING CONDITIONS INFORMATION

The small print: so you know where you stand.
By using our services you confirm that you accept these terms and that you agree to comply with them. We recommend that you read these terms carefully (in particular Clause 5 on liability). If there is anything within these terms that you do not understand, please contact us using the details in Clause 1. If you do not agree to these terms, you must not use our services or book a trip with us.
You warrant that you have the capacity to enter into a legally binding contract (including being at least the required age to have the capacity in your country).
1. DEFINITIONS
“Summit Guides” refers to the trip provider registered at Madryn, 3 Marian Terrace, Deiniolen, Caernarfon, Gwynedd, WALES, LL55 3HT (“we”, “us”, “our”).

‘Trip(s)’ refers to any event, course, or expedition provided by Summit Guides.
‘Trip Leader’ is the individual or individuals we engage to lead the event, course or expedition.
2. GENERAL BOOKING TERMS
A) Booking:
All participants must be 18 or over, unless accompanied by a parent or legal guardian.
All participants must comply with the ‘Experience required’ section of their Trip on our website when booking a Trip.
Your booking is confirmed when all of the following are completed: i) deposit made. Payments must be made in pound sterling (£150 for UK courses and vary for Overseas Expeditions) ii) you send us the completed Participant Details form and iii) we send you a Booking Confirmation email.
B) Payment:
Balance must be paid 4 weeks prior to the start of UK Courses and 8 weeks prior to the start of an Overseas Expedition.
Refunds are not available on Trip deposits.
C) Cancellations:
If you cancel before the Trip, you are entitled to the following refund:
On occasion, participants who are unable to attend a Trip have requested to postpone or send someone else in their place. Wherever possible, such changes will be accommodated at our discretion, especially for UK Courses. For Overseas Expeditions, this may however incur additional costs, such as administrative fees for changing a name on a peak permit or rebooking transport and accommodation.
We reserve the right to refuse requests for amendments to Trip dates or name changes after a deposit has been paid. In the event that amendments are not possible, you may either:
i) continue with the original booking, or;
ii) cancel. In the event of cancellation, the above cancellation terms apply.
If we cancel before the Trip, a full refund will be given – except in the event of Force Majeure specified in clause 4. No refunds are given once a Trip has started.
Refunds may take up to 28 days to process.
D) Itinerary Changes
In the event of a significant itinerary change prior to departure, the participant will be informed at the earliest opportunity and may:
i) agree with the suggested alternative or;
ii) cancel with a full refund.
While every effort is made to keep to the advertised itinerary, due to the nature of adventurous travel (weather, route conditions, local facilities, illness, etc.), itineraries are occasionally subject to minor last-minute changes.
E) Late joining/early return/early departure – Overseas Expeditions only
Late joining of the itinerary
Overseas Expeditions begin at a rendezvous point – generally a hotel, airport or other pre-arranged transport hub in country. In the event of your late arrival, you will have to make your own way to catch up with the trip itinerary, at your own expense.
Early return back to city hotel
In the event that we summit quicker than the advertised itinerary, you will be given the option of returning to the city hotel early. If you choose this option, any additional nights in a hotel not included the advertised itinerary will be paid for by you.
Early departure from a trip
If you leave the trip early, for whatever reason, you will have to pay for any associated costs (eg. transport, accommodation, food), as you will be deemed to have left the Trip.
4. FORCE MAJEURE
Except where otherwise expressly stated in these Terms and Conditions, we will not be liable or pay you compensation or a refund if our contractual obligations to you are affected by “unavoidable and extraordinary circumstances”, meaning any event beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include, but are not limited to: war, famine, riot, industrial dispute, earthquake, flooding, terrorism, weather conditions which make it impossible to travel to or remain at the destination, the act of government or other national or local authority, unavoidable technical problems with transport, disease (including Covid-19) and all similar events outside of our or our suppliers’ control,
5. LIABILITY
By signing the Participant Details form, you acknowledge and accept that mountain-based activities provided by Summit Guides carry the inherent risk of injury or death. You voluntary assume all such risks.,
We take all reasonable steps to ensure a safe and enjoyable trip, such as using a comprehensive Risk Management System, including Risk Assessments (both desktop and dynamic), using appropriately qualified & current Trip Leaders, and matching your experience and ability to the correct Trip.
To the extent permitted by law, we shall not be liable for any loss (including loss of possessions and loss of enjoyment) or damage, injury or death incurred by you as a result of any of the following:
i) Events which are unavoidable and extraordinary or ‘force majeure’ as defined in clause 4 above.
ii) Your failure to meet the Fitness level and Experience Requirements of the Trip,
iii) Missing, false or misleading information on the Participant Details form.
iv) Your failure to obtain appropriate insurance cover for your Trip.
v) Your failure to obtain the correct documentation, such as a passport or visa for your Trip.vi) Your failure, whether deliberate or accidental, to follow the reasonable instructions and guidance of the Trip Leader in matters of safety and for the smooth running of the Trip.
vi) Inappropriate or illegal behaviour due to alcohol or drugs.
vii) Failure by you to meet any other requirements of clause 5 below.
6. YOUR RESPONSIBILITY:
Before the Trip:
i) Admin – make timely payments as required, and accurately fill out the Participant Details form.
ii) Insurance – As a minimum for Overseas Expeditions, Insurance cover must include a) cancelation, b) medical and repatriation cover in the event of injury or death and c) helicopter evacuation to the relevant altitude of the trip. For UK Courses, cancelation cover for the course is recommended.
iii) Fitness and experience – ensure you arrive to the start of your Trip with the required fitness and experience (see the Experience Required on the website). If in any doubt about your fitness – consult your GP.
iv) Equipment – ensure you have all items on the Kit List, in good condition and fit for purpose. If you don’t have this kit, we may not allow you to join the trip.
v) For Overseas Expeditions, ensure you have a valid, in date Passport (check the specific expiry requirements for each country), visa and any vaccinations.
During the Trip:
vi) Observe any instructions from the Trip Leader – which will include both safety or logistical briefings. Failure to observe our directions and decisions will absolve us of responsibility.
vii) Where equipment is provided by us, you must use it responsibly and report any damage or fault immediately.
viii) Engage in the Trip to the best of your ability.

9. LEGAL
You and we both agree that any dispute, claim or other matter of any description which arises between us must be dealt with by the Courts of England and Wales.
If any court or relevant authority finds that part of these terms is illegal, the rest will continue in full force and effect.
